Terms of use of the Karlev e-shop
1. Scope and validity of the Terms
1.1 The Terms apply to the person (hereinafter the Guest) and Karlev OÜ, the owner of the shopping environment kristall.ee (hereinafter Kaubamaja). (the “Merchant”) regarding the legal relationship arising from the purchase of Products through the Kaubamaja.
1.2 In addition to these Terms and Conditions, legal relationships arising from the purchase of Products through the Kaubamaja are governed by the laws of the Republic of Estonia.
1.3 In addition to the terms of use of the Kaubamaja, the relationship between the Guest and the Merchant shall be governed by Good Practice and Purchase Information.
1.4 By making a purchase, the Guest agrees and acknowledges that he / she has read, read and understood the Terms of Use and Product / Service Instructions for the Products.
2. Products and Prices
2.1 The prices of the products are in EUR and include VAT.
2.2 The cost of the products will be added to the shipping fee according to the shipping method selected during the order process.
2.3 Product prices and availability are subject to change without notice. If the Guest has placed his order immediately before the price change takes effect, he will be charged the price at the time of placing the order.
2.4 The pictures of the products are for illustration purposes only and may differ slightly from the actual products.
3. Payment for Products
3.1. The guest can choose between two payment methods: by invoice (by wire transfer) or through the payment center via the bank link.
3.2 After the order is placed, the Guest will receive an electronic copy of his order, which will be used to pay for the goods.
3.3 Before paying the invoice, the visitor is obliged to check that the data on the invoice corresponds to the order (ordered products and contact information to which the order will be sent).
3.4 The guest can be paid by bank transfer. The guest must pay 100% of the order.
3.5 he order will be executed from the moment when the full amount of the order is credited to the Merchant’s current account.
3.6 If the Guest has not paid the Prepayment Invoice within 3 calendar days of the issue of the Prepayment Invoice, the Merchant shall consider that Guest to cancel the purchase and cancel the order.
3.7 In the event of more than five (5) canceled orders, the Merchant shall have the right to block the Guest User Account.
4. Delivery of Products
4.1.1 SmartPost OÜ parcel terminal (2.95€);
4.1.2 Itella / Smart Courier all over Estonia (4,50€);
4.1.3 Courier all over Estonia, Handle with care (12.50 €);
4.1.4 Pick up, at the Karlev OÜ showroom (Elektroni 2, Kristiine, Tallinn 13415) (0 €).
NB! All products that have a visible product price in the online store are 99.9% likely to be available at our office. So if you choose the delivery method: “Pick up in person, at Karlev OÜ office” – you can pick up your purchase the next business day.
If the product is out of stock, we will definitely inform the Buyer as soon as possible.
4.2 Delivery of the Products shall be carried out throughout Estonia.
4.3. Guests are required to verify the correct contact information before placing an order to avoid delays and misunderstandings in the delivery of the products. The Merchant shall not be liable for any delay or misunderstanding in the delivery of the Products if the delay or misunderstanding is due to the inaccuracy or inaccuracy of the information provided by the Guest at the time of placing the order.

We would be grateful if you would encourage your customers to collect their parcels from the machines as soon as possible in your purchase process and/or newsletters – this way we can speed up the movement of parcels to the parcel machines.

5. Cancellation, Product Returns and Warranty.
5.1 The Guest shall have the right to cancel his order prior to delivery of the Goods by sending a respective application to the Merchant by e-mail. The prepayment for a canceled order will be returned to the Guest’s bank account within 10 working days of submission of the application.
5.2 The visitor has the right to withdraw from the purchase made within 14 calendar days from the receipt of the goods. To do this, the Guest must send the Merchant a written withdrawal form by email, including the reason for the withdrawal, their details and the order number.
5.3 Returned goods must be: 5.3.1. unused,
5.3.2. in original packaging,
5.3.3. the original packaging must be intact
5.3.4. the product (s) must bear the original price tag and / or trademark. .
All four (4) conditions must be fulfilled simultaneously !!!In the event that all four (4) conditions are NOT satisfied at the same time, the Merchant shall have the right to refuse to take back the product and to refund the money.
5.4.Money returned for the goods, excluding transportation costs, will be credited to the Guest’s bank account within 10 calendar days of receipt of the goods by the Merchant. Notification of receipt of the parcel will be sent to the Guest’s e-mail.
5.5 The cost of returning the Goods shall be borne by the Guest.
5.6If the Product is received by the Guest, it must be returned within 14 calendar days of receipt of the item. In this case, the Guest may request either the replacement of the product or a refund. In the event of a defective product, the Merchant shall reimburse the shipping costs.
5.7 The Merchant warrants the originality of all goods and compliance with the quality standards established by the brand. All products on sale are carefully selected and each item is individually inspected for brand / number defects / errors / discrepancies.
6. Liability and Force Majeure
6.1 The Merchant and the Guest shall be liable to each other for any damage caused to the other by the breach of these terms and conditions in the cases and to the extent provided by the legislation of the Republic of Estonia.
6.2. Karlev OÜ is the controller of personal data and forwards personal data necessary for making payments to the authorized processor Maksekeskus AS.
6.2 The merchant is not responsible.
6.2.1 For product deterioration or damage due to the guest’s fault.
6.2.2 for defects that have arisen as a result of using the product for purposes other than its intended purpose;
6.2.3 for defects that have arisen during the use of the product if the Guest has used the product without following the usage/maintenance instructions.
6.2.4. for any delay in delivery of the goods caused by the transport company.
6.2.5. for broken goods that are broken through the fault of the transport company.
6.3 The Merchant is not liable for any damages caused to the Guest or for any delay in the delivery of the product if the damage or delay in the delivery of the product is due to a circumstance that the Merchant could not influence, did not foresee and could not have foreseen (force majeure).
6.4 The Merchant will not compensate for any moral damage that may be caused to the Guest by changes in delivery times, prices and other conditions within the framework of these terms and conditions.
7. Other conditions
7.1 During registration and purchases at the Kaubamaja, the Merchant stores the contact information entered by the Guest (first and last name, telephone number, regular and e-mail addresses) and information about the purchases made. The data received is treated as confidential information and is processed in accordance with the Personal Data Protection Act for the best planning of the purchase of goods, analysis of shopping habits and, as a result of the analysis, for making suitable offers to the Guest. The Merchant does not disclose the personal data of the Guest that has become known to it to a third party, except for cooperation partners for the purpose of delivering the order and in cases prescribed by law. The Guest has the right to see the data about him at the Merchant’s disposal and to prohibit further data processing.
7.2 Disputes arising between the Guest and the Merchant in connection with ordering and purchasing products through the Department Store shall be resolved through negotiations. If an agreement is not reached, the Guest has the right to apply to the Consumer Protection Board or Tallinn City Court to protect his or her rights. Disputes and issues not covered by these terms and conditions shall be resolved in accordance with the legislation in force in the Republic of Estonia.
